Agreement to Terms

These Terms of Use (these “Terms of Use” or this “Agreement”) govern Your use of the RISE ONLINE ACADEMY NEW MEXICO and its subsidiaries and affiliates (“RISE ONLINE ACADEMY NEW MEXICO,” “we,” or “us”) websites available at riseonlineacademy.org and any affiliate or derivative websites operated by RISE ONLINE ACADEMY NEW MEXICO (collectively, the “Site”) So long as You, Your child, or a child for which You are the legal guardian is/are enrolled in a program that uses the RISE ONLINE ACADEMY NEW MEXICO curriculum or technology, RISE ONLINE ACADEMY NEW MEXICO will grant access to and allow the use of the Site on behalf of Your Student(s) for purposes of providing educational and related services to You and Your Student(s). For purposes of this Agreement, the terms “You” “Your” and “Student” mean and refer to the person using the Site or the legal guardian of such person. By using the Site, You expressly acknowledge that You have read, understood, and agreed to be bound by these Terms of Use and any modifications that may be made to these Terms of Use from time to time. If You do not agree to these Terms, You should not use the Site. RISE ONLINE ACADEMY NEW MEXICO reserves the right to change the Terms of Use at any time without notice to You, effective immediately upon posting such revised Terms of Use on the Site. It is Your responsibility to check this page periodically to ensure You are complying with the most recent version of these Terms of Use. In addition, when using the Site, You are required to comply with any guidelines or rules applicable to each service offered within the Site, which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms of Use.

These Terms of Use constitute a binding legal agreement between You and RISE ONLINE ACADEMY NEW MEXICO, which details Your and the Student(s) rights and obligations as users (“User(s)”) of the RISE ONLINE ACADEMY NEW MEXICO Services available or provided through the Site (the “Services”). Please read these Terms of Use carefully before accessing or using the Site. All Users must accept these Terms of Use as a condition of using to the Services. When You accept the Terms of Use and complete the registration process for the
Services, You become a “Registered User” of the Site.

DESCRIPTION OF SERVICE
You understand and agree that the Site and the Services are provided “AS-IS.” RISE ONLINE ACADEMY NEW MEXICO makes no representations or warranties of any kind with respect to the Site or the Service s or any contents therein. RISE ONLINE ACADEMY NEW MEXICO assumes no liability or responsibility for any errors or omissions in providing the Services or the Site, any losses or damages arising from the use of the Site or the Services, or any conduct by users of the Site. RISE ONLINE ACADEMY NEW MEXICO assumes no liability or responsibility for the timeliness, accuracy or reliability of the Services, deletion, incorrect delivery, or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Services and for the payment of all fees associated with such access. You are also responsible for any fees associated with the display or delivery of advertisements. In addition, You must provide and are responsible for all equipment necessary to access the Site and Services.

YOUR REGISTRATION OBLIGATIONS
You agree to: (a) provide true, accurate, current and complete information as prompted by the Service’s registration form (the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current, or incomplete, or RISE ONLINE ACADEMY NEW MEXICO has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, RISE ONLINE ACADEMY NEW MEXICO has the right to suspend or terminate Your account and refuse any and all current or future use of the Services (or any portion thereof). Data You provide and certain other information about You received from third parties and affiliates such as schools, school districts and other agencies with which we work is subject to our Privacy Policy.

PERMITTED USE
You understand and agree that You are not authorized to use the Site for any purpose not expressly authorized herein. In particular, You agree that You may not use the Site for the benefit of anyone other than Your Student(s) and not for any other person. You will not use the Site for any unlawful purpose. You understand and agree that RISE ONLINE ACADEMY NEW MEXICO may discontinue or change the Site at any time, without notice. You understand RISE ONLINE ACADEMY NEW MEXICO reserves the right to revoke access without notice to the Site if RISE ONLINE ACADEMY NEW MEXICO has reason to believe that these Terms of Use have been or may be violated. You will not upload files, or cause users to upload files that contain viruses, corrupted files or any other similar software or programs that may adversely affect the operation of the Site or any other user’s experience on the Site. You will be fully liable for all costs or losses to RISE ONLINE ACADEMY NEW MEXICO or RISE ONLINE ACADEMY NEW MEXICO’s affiliates related to Your violation of these Terms of Use. RISE ONLINE ACADEMY NEW MEXICO may disclose user information about You if required by applicable law or by subpoena or court order.

REGISTERED USERS, PASSWORDS, AND SECURITY
You will receive a password and account designation upon completing RISE ONLINE ACADEMY NEW MEXICO registration process and becoming a Registered User. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under Your password or account. You agree to: (a) immediately notify RISE ONLINE ACADEMY NEW MEXICO of any unauthorized use of Your password or account, and (b) exit from Your account at the end of each session. RISE ONLINE ACADEMY NEW MEXICO is not liable for any loss or damage arising from Your failure to comply with this Section.

MODIFICATIONS TO SERVICE
RISE ONLINE ACADEMY NEW MEXICO reserves the right at any time and from time to time to modify or discontinue, temporarily, or permanently, the Services (or any part thereof) with or without notice. You agree that RISE ONLINE ACADEMY NEW MEXICO shall not be liable to You or to any third party for any modification, suspension, or discontinuance of the Services.

FILTERING SOFTWARE
You understand and agree that for Student(s) enrolled in a school that uses the RISE ONLINE ACADEMY NEW MEXICO technology and curriculum, federal, state, and/or local law may require that the computer made available to the Student(s) be equipped with filtering software to restrict access to Internet sites containing child pornography, obscene depictions, or other materials harmful to minors under 18 years of age. As legal guardian it is Your responsibility to install and maintain this software as required to meet federal, state, and/or local laws.

PROPRIETARY RIGHTS AND INTELLECTUAL PROPERTY
You acknowledge and agree that all technology, ideas, concepts, graphics, content, software, and materials available on the Site (“Content”) are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by RISE ONLINE ACADEMY NEW MEXICO, You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, broadcast, circulate, publicly display, publicly perform, publish, adapt, edit, translate, or create derivative works from such materials or content. Notwithstanding the above, You may print or download one copy of the materials or content on the Site on a single computer for Your personal, non- commercial use, provided You keep intact all copyright and other proprietary notices. Systematic retrial of data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database or directory without permission from RISE ONLINE ACADEMY NEW MEXICO is prohibited. You may not post any Content from the website to forums, newsgroups, mail lists, electronic bulletin boards or other websites, without the prior written consent of RISE ONLINE ACADEMY NEW MEXICO. You further agree not to reverse engineer any aspect of the Services or the Site, nor to use Your access of the Content, the Services or the Site to build or create a competitive product or service, or to create any product or service using ideas, features or functions similar to any aspect of the Content, Site or the Services. In addition, use of the Content for any purpose not expressly permitted in these Terms is prohibited.

LINKING AND THIRD PARTY SITES
You may not link or deep-link to this Site or any content contained on it without RISE ONLINE ACADEMY NEW MEXICO’s prior written consent. The Site may produce automated search results that reference or otherwise link to other sites on the Internet. These sites may contain information or material that some people may find inappropriate or offensive. These other sites are not under the control of RISE ONLINE ACADEMY NEW MEXICO, and You acknowledge that RISE ONLINE ACADEMY NEW MEXICO is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. The inclusion of such a link does not imply endorsement of the site by RISE ONLINE ACADEMY NEW MEXICO or any association with its operators, nor does RISE ONLINE ACADEMY NEW MEXICO warrant that other sites will be free from viruses or other damaging content or materials. RISE ONLINE ACADEMY NEW MEXICO may, in appropriate circumstances and at its sole discretion, terminate the access of users who infringe the copyright or intellectual property rights of others. RELEASE
YOU HEREBY RELEASE AND FOREVER DISCHARGE RISE ONLINE ACADEMY NEW MEXICO, THEIR OFFICERS AND DIRECTORS, AND THEIR EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, (“RELEASED PARTIES”), FROM ALL ACTIONS, CAUSES OF ACTION, INJURIES, CLAIMS, DAMAGES, COSTS OR EXPENSES OF ANY KIND GROWING OUT OF OR RELATED TO YOUR OR YOUR STUDENT(S)’ USE OF THE CURRICULUM, THE SITE OR THE SERVICE. YOU UNDERSTAND THAT THIS IS A FULL AND COMPLETE RELEASE TO THE MAXIMUM EXTENT ALLOWED BY LAW OF ALL CLAIMS AND DAMAGES WHICH YOU OR YOUR STUDENT(S) MAY HAVE AS A RESULT OF SUCH STUDENTS’ USE OF THE CONTENT, THE SITE OR THE SERVICES REGARDLESS OF THE SPECIFIC CAUSE THEREOF.

CHOICE OF LAW AND FORUM
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, excluding its conflicts of law terms. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms or Your use of the Site shall be filed only in the state or federal courts located in Salt Lake City, Utah, and You further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless RISE ONLINE ACADEMY NEW MEXICO and its subsidiaries, related or affiliated companies, and their employees, contractors, officers, directors, and agents from all liabilities, claims, and expenses, including attorney’s fees, that arise from Your use or misuse of the Site, Your use of the Services, Your connection to the Services or Your violation of these Terms of Use. RISE ONLINE ACADEMY NEW MEXICO reserves the right, at its own expense, to assume the exclusive defense and control of any matter.

Children’s Online Privacy Protection Act

RISE ONLINE ACADEMY NEW MEXICO (“RISE ONLINE ACADEMY NEW MEXICO,” “we,” or “us”) values the privacy of children and of all of its users. This COPPA Privacy Policy (“COPPA Policy”) is designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) and contains important information about how we collect, use, share, and protect the personal information we collect from children under thirteen years old that we may gather from the technology, software, systems, and websites that support our operations (collectively referred to as the “Site”) or that is provided to us by you or third parties.

Who Will Collect Information About Children?
RISE ONLINE ACADEMY NEW MEXICO collects personal information made available to RISE ONLINE ACADEMY NEW MEXICO by contracting educational agencies and institutions, such as student names, student identification numbers, e-mail addresses, GPA, grades, courses taken, standardized test scores, and related information.

RISE ONLINE ACADEMY NEW MEXICO operates in compliance with federal and state school privacy laws, including The Family Educational Rights and Privacy Act of 1974 (20 U.S.C. § 1232g; 34 CFR Part 99) (“FERPA”). FERPA is a federal law that protects the privacy of student educational records, and applies to all schools receiving federal funding. With certain exceptions, this law prohibits schools from releasing personal information of students under the age of 18 without parental consent. By designating RISE ONLINE ACADEMY NEW MEXICO as a “school official” and/or a designated contractor with a “legitimate educational interest,” educational agencies and institutions are permitted to share personal information with RISE ONLINE ACADEMY NEW MEXICO without express, parental consent under the exception provided by 34 CFR § 99.31(a)(1). The classification as a “school official,” or as a contracted company with a “legitimate educational interest” is described by the Family Policy Compliance Office (“FPCO”). The FPCO’s FERPA policy and advisory materials on this issue can be found at https://www2.ed.gov/policy/gen/guid/fpco/ferpa/index.html.

RISE ONLINE ACADEMY NEW MEXICO will handle children’s personal information as described in this COPPA Policy. Any personal information we collect about other users (e.g., teens and adults) will be treated in accordance with the RISE ONLINE ACADEMY NEW MEXICO Privacy Policy (“Privacy Policy”). The use of our Site and any dispute over privacy, is subject to this COPPA Policy, the Privacy Policy, and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. Our Terms of Service and Privacy Policy are incorporated by reference into this COPPA Policy. Even if RISE ONLINE ACADEMY NEW MEXICO works in conjunction with an outside partner, the partner will not receive any individual personal information from users of the Site, including children. RISE ONLINE ACADEMY NEW MEXICO may provide partners with aggregate or de-identified information about users.

Your Personal Information

RISE ONLINE ACADEMY NEW MEXICO may use your personal information to:

  • Contact you about your or your children’s participation in a RISE ONLINE ACADEMY NEW MEXICO program and for other customer service purposes;
  • Provide you with resources, products, and services, including but not limited to support services related to your use of the Site, that you request from us;
  • Provide you with information about new products and services available through RISE ONLINE ACADEMY NEW MEXICO and resources and support services related to your use of the Site, if you choose to receive such information. If you have opted in to receive such information, you can request to opt out of receiving this information in the future by making a request in writing to privacy@riseonlineacademy.org;
  • Automatically fill out certain forms and surveys upon your instructions to do so;
  • Help diagnose problems with and administer our Site;
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us; and
  • Comply with applicable legal requirements and industry standards.

We may aggregate your information with the information of other users for our own internal statistical, design, and/or operational purposes, such as to estimate our audience size, measure aggregate traffic patterns, and understand demographic, customer interest, and other trends among our guests and customers.This aggregate information generally will not personally identify you or be correlated to you individually for external purposes.

We also may use the information we obtain about you in other ways for which we provide specific notice at the time of collection.

What Information Do We Collect About Children and Why?
As described in further detail below, we collect some personal information from children so that we can track their progress through our programs. Data is retained for education purposes only.

How Information is Collected?
We may collect information about children directly from children, through our contracted educational agencies and institutions, as well as automatically through a child’s use of our Site and Services. We will not require a child to disclose more information than is reasonably necessary.

Student Records
RISE ONLINE ACADEMY NEW MEXICO only receives personal information about your children as set forth in the “Student Records” section above and/or directly from you when you enroll your children into a RISE ONLINE ACADEMY NEW MEXICO program. If your children are enrolled in a RISE ONLINE ACADEMY NEW MEXICO program, we will collect, use, and maintain personal information about your children solely (i) to provide RISE ONLINE ACADEMY NEW MEXICO programs to them and for other authorized educational purposes, and/or (ii) as otherwise authorized by you.

You can review certain personal information that RISE ONLINE ACADEMY NEW MEXICO has regarding your children by making such a request in writing to privacy@riseonlineacademy.org. Please be aware that some personal information relating to your children’s educational records may not be able to be disclosed by RISE ONLINE ACADEMY NEW MEXICO due to state and/or federal law. You can request that your children’s personal information not be used by RISE ONLINE ACADEMY NEW MEXICO and contractors and service providers acting on behalf of RISE ONLINE ACADEMY NEW MEXICO by making a request in writing to privacy@riseonlineacademy.org. Please be aware that if you make such a request, your children can no longer continue to be enrolled in a RISE ONLINE ACADEMY NEW MEXICO program or to use most features on our Site. Therefore, a request by you for RISE ONLINE ACADEMY NEW MEXICO and our contractors and service providers to no longer use your children’s personal information will terminate your children’s participation in the RISE ONLINE ACADEMY NEW MEXICO program in which they are enrolled.

Parents have a right to review the information we have collected about their children and students, respectively, and to delete it, and to tell us to stop using it. To exercise these rights, you may contact us at privacy@riseonlineacademy.org. You will be required to authenticate yourself as the child’s parent to receive information about that child.
